Assumption of risk

Scuba diving, technical diving, cave diving, wreck diving, mixed-gas diving, and closed-circuit rebreather (CCR) diving are inherently hazardous activities that can result in serious injury, including decompression illness, drowning, hypoxia, hyperoxia, hypercapnia, and death. By purchasing and using any product sold by Rugged Scuba, you expressly acknowledge that you have read and understood this notice and you voluntarily assume all risks associated with your diving activities and with the use of every product.

Training

You represent that you are currently certified for the type of diving in which you will use Rugged Scuba products, that you will not exceed the limits of your training, experience, or physical fitness, and that you will dive only with appropriate planning, gas, and team support.

Inspection, service, and compatibility

You are responsible for inspecting every product before each use; for verifying compatibility with your regulator, cylinder, valve, rebreather, and gas mix; and for having service performed by personnel qualified for the specific equipment. Rugged Scuba does not service regulators, rebreathers, or other life-support components and does not certify third-party service.

Aftermarket accessories

Certain Rugged Scuba products are aftermarket accessories for equipment manufactured by third parties (including but not limited to JJ-CCR, Fathom Dive Systems, iQsub, Halcyon, Light Monkey, and others). Those products are not manufactured, endorsed, or authorized by those OEMs; all trademarks are property of their respective owners and are used solely for compatibility identification. Use of any aftermarket accessory may affect your OEM warranty.

Limited warranty

Products manufactured or assembled by Rugged Scuba are warranted against manufacturing defects for the period stated on the product page (90 days unless otherwise specified). The sole remedy under this warranty is repair or replacement at Rugged Scuba’s option. This warranty does not cover normal wear, impact, misuse, unauthorized modification, improper service, environmental damage, or any condition arising from use beyond the product’s stated ratings or limitations. Pre-owned and outlet items are sold AS IS, WHERE IS, WITH ALL FAULTS and no warranty of any kind.

Disclaimer of implied warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RUGGED SCUBA DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RUGGED SCUBA’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO ANY PRODUCT OR ITS USE SHALL NOT EXCEED THE PURCHASE PRICE PAID FOR THAT PRODUCT. RUGGED SCUBA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION PERSONAL INJURY, DEATH, LOSS OF USE, OR LOSS OF DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

Indemnification

You agree to indemnify, defend, and hold harmless Rugged Scuba, its owners, officers, employees, and suppliers from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or relating to your use, misuse, or modification of any product, your breach of these Terms, or your breach of any applicable law or regulation.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising under these Terms or relating to any product shall be brought exclusively in the state or federal courts located in Los Angeles, California, and you consent to personal jurisdiction there.

Severability

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
